These Terms of Service ("Terms") govern your access to and use of Vestiry - Try On, its mobile application, website, virtual wardrobe, virtual try-on tools, credit wallet, subscriptions, and related services (collectively, the "Services"). The Services are provided by Vestiry Inc. ("Vestiry", "we", "us", or "our").
By installing, accessing, creating or linking an account, purchasing credits, starting a subscription, or using any part of the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
These Terms are a contract. Please read the sections on recurring subscriptions, credits, disclaimers, limitation of liability, dispute resolution, and the United States-specific terms carefully.
1. Eligibility and age requirements
- You must be at least 13 years old, or the minimum age of digital consent in your country, whichever is higher.
- The Services are not directed to children under 13. Do not create an account for a child under 13 or upload a child's image without all legally required consent.
- If you are under the age of majority where you live, your parent or legal guardian must review and accept these Terms and is responsible for your use of the Services.
- You may not use the Services if applicable law prohibits you from doing so.
2. Accounts, anonymous sessions, and security
- The App may begin with an anonymous Firebase session. An anonymous session is not a substitute for a recoverable account and may be lost if the device session is removed.
- You may link or create an account using supported authentication providers. You are responsible for accurate information and for protecting access to your account.
- You are responsible for activity under your account, except where caused by our breach of applicable law.
- Notify us promptly if you believe your account or purchase has been compromised. We may suspend access to protect users, the Services, or the payment system.
3. User content and image permissions
You retain ownership of photographs, garment information, outfit data, and other material you submit ("User Content"). You represent and warrant that:
- You own or have permission to use and upload the User Content.
- You have obtained the consent required to upload another person's image, including any consent required for biometric or sensitive-image processing.
- Your User Content does not violate privacy, publicity, intellectual-property, confidentiality, employment, or other rights.
- Your User Content is not unlawful, abusive, sexually exploitative, threatening, defamatory, or otherwise prohibited by these Terms.
You grant Vestiry a limited, worldwide, non-exclusive, royalty-free license to host, copy, transform, transmit, and process User Content only as necessary to operate, secure, maintain, improve, and provide the Services you request. This license ends for active systems when the relevant content is deleted, subject to backups, legal records, fraud prevention, and third-party retention described in the Privacy Policy. We do not claim ownership of your original images or generated results.
4. Virtual try-on and AI-generated results
- Virtual try-on, outfit, color, and related AI results are simulations for inspiration and visualization. They are not measurements, professional styling advice, medical advice, safety advice, or a guarantee of fit, color, texture, size, availability, or appearance.
- Results may be inaccurate, incomplete, distorted, unavailable, or different from the physical garment or person.
- You are responsible for reviewing results before relying on or sharing them. Do not use the Services to make decisions requiring professional or safety-critical accuracy.
- Images may be transmitted to third-party AI processors, including Perfect Corp, to perform the requested operation. The applicable third-party terms and privacy policy also apply to that processing.
- You may use generated results for your personal use, subject to the rights of people, brands, garments, and other material appearing in the result. You are responsible for commercial or public use.
5. Credits and wallet
The Services may use virtual credits. Credits are a limited, revocable license to access designated features; they are not money, deposits, securities, property, or a cash equivalent.
- Welcome credits: The amount is controlled by Firebase Remote Config and may be granted once per eligible account.
- Daily and rewarded credits: These may be limited by daily or monthly rules and may require an eligible action or advertisement.
- Subscription credits: These are granted to an active subscription according to the applicable plan and monthly benefit period. They do not accumulate across benefit periods.
- Purchased credits: These are granted after Google Play purchase verification and expire according to the credit rules shown in the App and applicable plan information. They are not transferable.
- Credits are consumed by the feature and cost displayed or otherwise disclosed before the operation. We may correct ledger errors, reverse fraudulent grants, or refund credits when required by law.
- Credits cannot be sold, transferred, exchanged for cash, withdrawn, or transferred between accounts.
- Changing an economy parameter does not retroactively change a completed transaction unless required to correct fraud or an obvious processing error.
6. Purchases, subscriptions, trials, and refunds
Digital purchases are processed by Google Play Billing. Vestiry does not receive or store your full payment-card number. Google Play may require its own account, payment method, terms, and authentication.
6.1 One-time credit packs
Available packs, price, currency, taxes, and credits are shown by Google Play and the App before purchase. The current catalog may include 10, 30, and 100 credit packs. A pack is credited only after server-side verification of the Google Play purchase.
6.2 Recurring subscriptions
- Subscriptions may be offered in monthly or annual base plans. The billing period, renewal price, taxes, trial eligibility, and currency are determined by Google Play and shown on the purchase screen.
- Unless Google Play states otherwise, a subscription renews automatically at the end of each billing period until canceled.
- Canceling stops a future renewal but normally does not remove access already paid for before the current period ends.
- You must manage cancellation, payment method, renewal, pause, and plan changes in Google Play. Deleting a Vestiry account does not itself cancel a Google Play subscription; Vestiry may require cancellation before completing account deletion to prevent continued charges.
- Subscription benefits are granted only after Google Play verification. Monthly benefit credits are non-accumulating and may be replaced at the beginning of the applicable benefit period.
6.3 Free trials and introductory offers
Offers are eligibility-based and may not be available to every user. The current Play catalog may offer a 7-day Pro monthly trial. Unless Google Play states otherwise, the subscription begins charging at the disclosed price after the trial ends unless you cancel before the trial deadline. The App cannot guarantee that an offer remains available.
6.4 Refunds and charge disputes
Google Play controls payment processing, receipts, refunds, chargebacks, taxes, and most payment disputes. Request refunds through the Google Play process or the support path Google provides. We may suspend benefits associated with refunded, reversed, fraudulent, or voided transactions, subject to applicable law.
If a purchased credit pack is refunded after some of its credits were used, Vestiry removes any remaining credits from that pack and records the used portion as pending credit debt. Generations remain blocked while that debt exists. A later verified credit-pack purchase is applied first to the pending debt; only any remaining amount becomes usable credits. Free, rewarded, and subscription credits do not automatically cancel this debt.
7. Advertising, analytics, and third-party services
- The free experience may include rewarded and interstitial advertisements supplied by Google Mobile Ads. Availability and personalization depend on device settings, consent, region, and Google policies.
- Firebase Analytics and other operational services may process technical and usage events as described in the Privacy Policy.
- Firebase, Google Play, Google Sign-In, Google Mobile Ads, and Perfect Corp are independent third parties. Their terms, policies, availability, and processing practices may apply.
- We are not responsible for third-party outages, decisions, content, policies, or data practices, except where applicable law provides otherwise.
8. Acceptable use and prohibited conduct
You must not:
- Use the Services for unlawful, fraudulent, abusive, harassing, discriminatory, or harmful activity.
- Upload images without permission, sexually exploitative content, unlawful content, malware, or content that violates another person's rights.
- Reverse engineer, decompile, scrape, copy, resell, rent, sublicense, or create a competing service from the Services, except to the extent a restriction cannot lawfully apply.
- Probe, bypass, or interfere with authentication, billing, security rules, rate limits, access controls, provider controls, or the credit ledger.
- Use bots, automation, multiple accounts, fake advertisements, chargebacks, manipulated purchase receipts, or other methods to obtain credits or benefits improperly.
- Use AI results to impersonate, defame, surveil, discriminate against, or harm a person.
9. Intellectual property
The App, website, software, design, trademarks, logos, text, and service technology are owned by Vestiry or its licensors. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. No rights are granted except those expressly stated.
10. Availability, changes, and termination
- We may change, suspend, limit, or discontinue features, prices, credit costs, plans, or availability. We will provide notices required by law for material changes.
- We may suspend or terminate access for fraud, abuse, security risk, legal requirement, non-payment, or material breach. Where appropriate, we will provide an opportunity to resolve the issue.
- You may stop using the Services and request account deletion as described in the Privacy Policy. Account deletion is permanent and does not automatically cancel third-party subscriptions.
- Sections that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, liability limits, dispute resolution, and applicable law, survive termination.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE". We disclaim warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, and uninterrupted or error-free operation. We do not warrant that AI results, credit balances, third-party services, or payment availability will always be accurate or uninterrupted.
12. Limitation of liability
To the fullest extent permitted by law, Vestiry and its officers, employees, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, content, credits, or access arising from the Services. To the fullest extent permitted by law, our aggregate liability for claims relating to the Services will not exceed the greater of the amount you paid to Vestiry through the Services during the 12 months before the event giving rise to the claim or USD 100. Nothing in these Terms excludes liability that cannot legally be excluded.
13. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Vestiry and its affiliates, officers, employees, licensors, and service providers from claims, losses, liabilities, costs, and expenses arising from your User Content, misuse of the Services, violation of these Terms, violation of another person's rights, or violation of law. This obligation does not apply to the extent caused by Vestiry's own unlawful conduct.
14. United States additional terms
This section applies if you reside in the United States. It supplements the rest of these Terms and prevails only where required by applicable law.
- Dispute resolution: Before filing a formal claim, you and Vestiry agree to attempt good-faith informal resolution by sending written notice to the support address below. If a dispute is not resolved within 30 days, either party may pursue it in small-claims court where eligible or through individual arbitration, except for claims that cannot legally be arbitrated.
- Individual arbitration and class waiver: To the fullest extent permitted by law, disputes will be resolved individually and not as a class, representative, or consolidated action. You may opt out of arbitration by sending a written request within 30 days after first accepting these Terms, identifying your account and stating that you opt out.
- Injunctive relief: Either party may seek temporary or permanent injunctive relief in a court of competent jurisdiction for misuse of intellectual property, confidential information, or security controls.
- State rights: Nothing in these Terms waives non-waivable consumer, privacy, refund, accessibility, or other rights under the laws of your state. California residents may contact us regarding California consumer rights, and residents of states with specific privacy or automatic-renewal laws may exercise the rights described in our Privacy Policy.
- Automatic renewal notice: The Google Play checkout screen controls the legally required disclosure of recurring price, renewal date, trial conversion, cancellation deadline, and taxes. Review that screen before confirming a subscription.
15. Governing law
These Terms are governed by applicable law without regard to conflict-of-law rules, except that mandatory consumer protections in your place of residence remain applicable. The courts or arbitration forum permitted by applicable law will have jurisdiction.
16. Changes to these Terms
We may update these Terms to reflect changes in the Services, law, or business. We will update the effective date and provide additional notice for material changes when required. Continued use after the effective date means you accept the updated Terms.
